How the Law Defines a Church

First off, lets look up Black Laws Dictionary 5th Edition’s Definition of what a “Church” is:

Church. In its most general sense, the religious society founded and established by Jesus Christ, to receive, preserve, and propagate His doctrines and ordinances. It may also mean a body of communicants gathered into church order; body or community of Christians, united under one form of government by the profession of the same faith and the observance of the same ritual and ceremonies; place where persons regularly assemble for worship; congregation; organization for religious purposes; religious society or body; the clergy or officialdom of a religious body.

A Church is NOT defined as four walls and a steeple. In fact, just like how with the United States government, WE THE PEOPLE are the Government, and the officials are considered, ‘Public Servants’, this definition above means that if you are a Christian and you desire to receive, preserve and propagate this doctrines and ordinances, then for all intents and purposes, YOU ARE THE CHURCH. The Church is not the building, it is the people in the building. Such as when Jesus said, “If they still refuse to listen, tell it to the church; and if they refuse to listen even to the church, treat them as you would a pagan or a tax collector.” From, Matthew 18:17.


Now, under the mandatory tax exemption laws of both 26 USC 508(c)(1)(a) and 26 USC 6033(3)(a)(i-iii) does this automatically make YOU as an individual tax exempted since as a Christian your the Church? Since the word, ‘Church’ is legally designated as being mandatorily tax exempted and since the Federal Government has no official legal definition for the word Church, one could possibly make an argument that this is possible right? The answer is NO, NOT IN ANYWAY SHAPE OR FORM. You must always remember to file your personal income tax liability if lawfully owed to the Federal Government. Your Church is a completely different story altogether though. In our opinion, so that there is no misuse of the Corporation Sole, we require any Pastor willing to apply for our ministry support to have at least 3 Church members that are willing to sign under the penalties of perjury, your Churches, “Church Establishment Affidavit”. Without meeting this requirement, our Church will not help you in establishing either your Church or it’s subsequent office of the religious Corporation Sole.


It is absolutely imperative that you understand that in order to create a true lawful Corporation Sole, you must already have an established Church/Ministry. If you have never done this before (lawfully established your ministry), then this can easily be done by filling out, signing, witnessing and having notarized our custom, “Church Establishment Affidavit“. We’ve paid very careful attention when we created this affidavit and taken into account Christians that have home based and internet based ministries. In fact, we even made careful attention that this affidavit lawfully fulfills ALL 14 points to the IRS and Federal Governments own requirement’s for being legally recognized as a Church (in the event you were brought before the IRS commission during an official tax inquiry).

Once you do complete this affidavit process, it will be the highest form of evidence in a Federal Courtroom regarding your ministries distinct legal existence.
